Afterpay Charity Donation Terms & Conditions

These Donation Terms and Conditions (“Terms”) constitute a legally binding agreement between you and Afterpay US, Inc, (“Afterpay,” “we,” “us”) governing your use of the charity donation program (the “Feature”). Use of the Feature is subject to these Terms, the Afterpay Privacy Policy and Terms of Service. 


Any defined terms contained herein shall have the same meaning as those in the Afterpay Terms of Service or in the Installment Agreement associated with your Donation. If there is any conflict between the Afterpay Installment Agreement and / or Afterpay Terms of Service and these Donation Terms & Conditions, the terms of these Donation Terms & Conditions shall control. If you do not agree to these Terms you may not use the Feature. 



1. The Charity Donation Program 

The Feature allows customers with an Afterpay account to donate $1 to be provided automatically to one or more public interest organizations that have partnered with Afterpay (“Afterpay Partner”) at the time that they make an Afterpay Purchase (a “Donation”). Where multiple Afterpay Partners are designated, Afterpay will distribute your Donation equally among the partners designated. Use of the Feature is an optional, separate transaction made directly with Afterpay. It is not a part of or incorporated into your Installment Agreement or contract of sale with the merchant from whom you are purchasing goods or services. 


2. Payment and Donations 

By selecting the checkbox to use the Feature in connection with an Afterpay Purchase, you authorize Afterpay to charge $1 to your payment method selected in connection with that Purchase. This amount will be charged at the same time and will be added to the total amount of your first payment under your Payment Schedule under your Installment Agreement. Afterpay will hold your Donation and donate it to one or more Afterpay Partners on a monthly basis. 100% of your Donation will be donated to the Afterpay Partners designated to receive the Donation by You. The Donation amount will not appear in your Payment Schedule associated with your Afterpay Purchase, but you will receive acknowledgment of the Donation made in your order confirmation email associated with your Afterpay Purchase. Donations are not refundable and will not be returned even if you cancel, exchange or return the Afterpay Purchase associated with your order. 


3. Afterpay Partners 

If Afterpay is unable to complete a Donation to the designated Afterpay Partner(s), then Afterpay may, within sixty (60) days, elect to (a) refund the Donation or (b) route the Donation to another Afterpay Partner of Afterpay’s choosing. Afterpay reserves the right to remove any Afterpay Partner from the Feature at any time and for any reason. Afterpay does not make any guarantees or representations that any Afterpay Partner will continuously operate or qualify as charitable organizations or that their missions will remain the same. Afterpay disclaims liability for, and makes no guarantees or representations with respect to, how the Donation will be spent by the Afterpay Partner, or any potential tax deductions or benefits (if any) that you may receive as a result of any Donation. Some Donations may not be eligible for tax deductions or other benefits. Those who make Donations are solely responsible for undertaking any required reporting and for claiming any applicable tax benefits that they wish to seek. 


Afterpay will process your personal information in accordance with its privacy policy, including as may be required to comply with applicable law. 


4. Indemnity/Limitation of Liability 

To the extent not prohibited by law, under no circumstances shall we, our subsidiaries, partners, or affiliates, be liable to you for: (a) personal injury or any indirect, incidental, consequential, special or exemplary damages, arising from or relating to these Terms or the Feature; or (b) except as required under applicable law, any indirect, incidental, consequential, special or exemplary damages, arising from or relating to the conduct of you or anyone else in connection with the Feature. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY. ACCORDINGLY, SOME OF THIS SECTION MAY NOT APPLY TO YOU. You agree that if any lawsuit or court proceeding is permitted under these Terms, the aggregate liability of us and our affiliates and suppliers to you for all claims arising out of or related to these Terms or your use or inability to use the Feature will not (other than as may be required by applicable law in cases involving personal injury) exceed the amount of five hundred U.S. dollars ($500.00). These limitations will apply even if the above stated remedy fails of its essential purpose. 


5. Indemnification 

You agree to release, indemnify and hold harmless us, our affiliates, and our and their respective officers, directors, employees and agents from and against any claims, liabilities, damages, losses and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way related to: (a) your breach or alleged breach of these Terms; (b) your violation of any rights of a third party, including but not limited to any negligent or willful misconduct of your employees, contractors, or agents, or a breach of any contracts or other relationships between you and third parties; (c) your violation of any applicable law; or (d) your failure to provide and maintain true, accurate, current and complete information in connection with your use of the Feature. You shall cooperate as fully as reasonably required in the defense of any such claim. Afterpay reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree not to settle any matter without the prior written consent of Afterpay. For the avoidance of doubt, this indemnification, defense and hold harmless obligation will survive these Terms and the termination of your use of the Feature. 


6. General

Afterpay may discontinue the Feature at any time and without notice, provided that all Donations made prior to discontinuance will be delivered and treated in accordance with these Terms.

A Common Thread is a fundraising initiative spearheaded by Vogue and The Council of Fashion Designers of America (CFDA), to raise both awareness and needed funds for those in the American fashion community who have been impacted by the COVID-19 pandemic.

 

The CFDA/Vogue Fashion Fund was originally established as a response to the tragedy that took place on 9/11. Now, as we are all faced with new challenges, it is being repurposed to— in addition to raising and distributing funds to those who have been most affected—highlight designers and tell the stories of those who work tirelessly behind the scenes across the country in our incredibly strong and vibrant fashion industry.

Baby2Baby

 

Baby2Baby provides children living in poverty, ages 0-12 years, with diapers, clothing and all the basic necessities that every child deserves.

 

Through their COVID-19 relief efforts, Baby2Baby has distributed 13 million essential items including diapers, hygiene, baby food, formula and more to children and families impacted by COVID-19.

 

Even before the COVID-19 crisis, 1 in 3 moms in this country was struggling to afford diapers and other basic necessities. Now, with more lost jobs and lack of any income, they are being forced to make impossible choices like deciding whether to buy diapers or food.

 

When Baby2Baby can provide these families with diapers, hygiene and other essentials, they have the ability to use their funds to focus on food and shelter.

 

In the last 9 years, Baby2Baby has distributed over 100 million items to children in homeless shelters, domestic violence programs, foster care, hospitals and underserved schools as well as children who have lost everything in the wake of disaster.


Magpies and Peacocks 


Magpies & Peacocks is a Houston based non-profit design house (501c3) dedicated to the collection, curation, and sustainable reuse of post consumer textiles, to disrupt the cycle of waste in the fashion industry. They collaborate with a network of designers, makers and artists to create unique up-cycled products, provide a resource library of reusable material for the creative community, offer skill building and sustainability education, and incubate circular fashion innovation. 

 

A key focus of Magpies & Peacocks’ work is their MAKR Collective - an upskilling program providing training for survivors of human trafficking and domestic violence in life-long making skills for employment, with opportunities at Magpies & Peacocks not only within fashion but throughout the design and manufacturing industries. With a focus on the therapeutic aspect of hand skills, training includes sewing, pattern cutting, alterations and sustainable design – based on a client’s interest and organic skillset.
