It’s important to read the terms and conditions in full before entering this competition, but here’s a summary of the key terms:


  • Entry is open to Australian residents 18 years and older.
  • The Promotion starts at 9.00am on 22/12/2023 and closes at 11.59pm on 1/1/2024 AEDT.
  • To enter, you need to: 
  1. Follow both Instagram handles @afterpayau & @mastercardau on Instagram.
  2. Like this promotional post.
  3. In 25 words or less, tell us in the comments below the post who your favourite Aussie tennis star is & why (see below for full details).
  • You can only enter once and each person can only win one prize.
  • The judging will occur at 9.00am on 3/1/2024 AEDT, and a total of 1 winner will be notified by Instagram direct message and have their name published at www.afterpay.com/en-au/ausopen-giveaway. 
  • Each Eligible Entry will be individually judged (by representatives of Afterpay) on the set criteria of: The most creative response provided.
  • The winner will receive "The ultimate money can't buy Australian Open experience!". Total prize pool value is AU$3000.
  • This competition is administered by the Promoter, and not Instagram.
  • Your Personal Information may be used by the Promoter and disclosed to third parties for various purposes (see clauses 24-26 for full details).
  • Afterpay accepts no responsibility for: (i) late, lost or misdirected entries, (ii) prizes lost, misplaced or otherwise not delivered to a winner, (iii) errors (technical or human), technical failures or malfunctions except where caused by Afterpay’s fraud, negligence or wilful misconduct, and (iv) any injury, sickness, death, or property loss or damage of any kind except where caused by Afterpay’s fraud, negligence, or wilful misconduct.
  • If the promotion cannot be run as planned for any reason beyond the reasonable control of Afterpay, Afterpay may, subject to licensing authority approval, alter, cancel, terminate, modify or suspend the promotion.
  • Afterpay may disqualify entries and entrants for a number of reasons, including if you breach these terms (see clause 10 for full details).

Promotion Partner

2. The Promotion Partner is Mastercard Asia/Pacific (Australia) Pty Ltd (ABN 95 108 603 345) at Level 8, 100 Arthur Street, North Sydney NSW 2060, Australia, who may benefit from the undertaking of this competition


Eligibility

3. Entry is open to Australian residents aged 18 years and over (Eligible Entrants). The winner and all guests of the winner must be over 18 at the time of redemption.


4. Employees and other staff (and their immediate family members) of the Promoter or the Promotion Partner are ineligible to enter.


5. Entrants are subject to all applicable laws, and entries will be deemed void where prohibited by law.


6. By entering this competition, entrants agree to be bound by these terms and conditions. In case of any inconsistency between these terms and conditions and any other published material, these terms and conditions prevail.


Entry

7. The Promotion commences at 9.00am on 22/12/2023 and closes at 11.59pm on 1/1/2024 AEDT (Promotion Period).


8. To enter, during the Promotion Period Eligible Entrants must:

  3. In 25 words or less, tell us in the comments below the post who your favourite Aussie tennis star is & why.


9. Eligible Entrants may only enter once. Each Eligible Entrant may only be awarded one prize. All entries become the property of the Promoter for use by the Promoter without attribution or compensation.


10. Entries that the Promoter suspects to be fraudulent, incomplete, incorrect or misleading, or may damage the Promoter’s reputation may be disqualified. Entrants who breach these terms and conditions may be disqualified. The Promoter accepts no responsibility for late, lost or misdirected entries.


11. It is the entrant’s responsibility to notify the Promoter should their contact details change during the Promotion Period. 


12. Entrants are providing information to the Promoter, and not to Instagram. This competition is in no way associated with, sponsored, endorsed or administered by Instagram. Entrants’ use of Instagram is governed by its Terms of Use, accessible from the Instagram website. Entrants release Instagram from all liability associated with this competition to the extent permitted by law. 


13. This competition adheres to the terms of conditions set out in the Instagram promotion guidelines. All content published on Instagram may be moderated by Instagram.


14. The Promoter may determine whether any of the content submitted by an entrant will remain on its Instagram page, and reserves the right to remove any content at any time in its sole discretion. Entries and associated Instagram usernames may be publicly viewed.


15. There is no fee to enter this competition.


Prizes and winning

16. This is a game of skill. Chance will play no role in determining the winner. Each Eligible Entry will be individually judged (by representatives of Afterpay AU) on the set criteria of: The most creative response provided. The winner will be selected from all valid entries received during the Promotion Period. Entries will be judged at 9.00am on 3/1/2024 AEDT at 320 Pitt Street Sydney.


17. There will be a total of 1 winner, who will be notified by Instagram direct message within 2 business days of the judging date on 3/1/2024. Winners’ names will be published within 2 business days of the judging date on 3/1/2024 on www.afterpay.com/en-au/ausopen-giveaway for at least 2 days.


18. The winner will receive "The ultimate money can't buy Australian Open experience!". Total prize pool value is AU$3000. Prizes are subject to any terms and conditions (which may be notified to the winner upon confirmation of the award of the prize).


19. If the prize remains unclaimed after reasonable attempts to contact the winner, this will be published 2 business days after the initial prize judging on 5/1/2024. A subsequent unclaimed prize judging will be conducted at 9.00am on 7/1/2024 AEDT at 320 Pitt Street Sydney. Any rejudging winner will be notified by Instagram direct message within 2 business days of the unclaimed prize judging on 7/1/2024 and will have their name published on www.afterpay.com/en-au/ausopen-giveaway for at least 30 days.


20. The Australian Open 2024 ticket prizes are subject to the event venue and ticket terms and
conditions, including any applicable age restriction. The Promoter and event organisers
hereby expressly reserve the right to eject the winner (and/or his/her companion/s) for any
inappropriate behaviour, including but not limited to intoxication, whilst participating in any
element of the prize.

21. All Australian Open tickets are issued subject to the Australian Open Ticket Conditions of
Sale and Entry 2024 (which can be found online at https://ausopen.com/conditions-of-sale-
entry). The winner consents to Tennis Australia Limited using their personal information and
photographing/recording them while they are participating in the any activity or event run or
organised by Tennis Australia which constitutes part of the prize. The winner agrees that any
such photographs, electronic images, sound recording or video footage may be used by
Tennis Australia in resources and reports, or promotional, advertising or marketing materials,
without any further notice or payment to the winner.


22. The Promoter may request reasonable identification the winner to confirm their identity and eligibility to enter. Any failure to do so may result in disqualification.


23. The Promoter accepts no responsibility for prizes lost, misplaced or otherwise not delivered to the winner. If any prize or part of a prize becomes unavailable for reasons outside of the Promoter’s control, the Promoter may substitute a prize of equal or greater value. Prizes are not transferable or redeemable for cash.


24. The Promoter’s decision on any aspect of this promotion is final and binding. No correspondence will be entered into.


25. No bonus prizes shall be awarded. 


Marketing and privacy

26. Personal Information, for the purposes of the Privacy Act 1988 (Cth), means information or an

opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a

material form or not.


27. Entrants consent to their entry and Personal Information being used by the Promoter for

marketing purposes. The Promoter may use, reproduce or modify the entry in any way without

any further reference, payment or compensation to the entrant.


28. Personal Information collected will be used in accordance with the Promoter’s Privacy Policy

(https://www.afterpay.com.au/privacy/). The Promoter may disclose Personal Information to other

organisations (including third parties) for the purposes of conducting the promotion, promotional

marketing, publicity, research and profiling. Entrants may access or change their personal

information by contacting the Promoter by email at [email protected].


Other terms

29. These terms and conditions do not limit, modify or exclude consumer guarantees as provided

under the Competition and Consumer Act 2010 (Cth). The Promoter may amend any of these

terms and conditions if required to comply with applicable laws.


30. The Promoter accepts no responsibility for errors (technical or human), technical failures or

malfunctions except where caused by the Promoter’s fraud, negligence or wilful misconduct.


31. The Promoter accepts no responsibility for any injury, sickness, death, or property loss or

damage of any kind except where caused by the Promoter’s fraud, negligence, or wilful

misconduct.


32. If the promotion cannot be run as planned for any reason beyond the reasonable control of the

Promoter, the Promoter may, subject to licensing authority approval, alter, cancel, terminate,

modify or suspend the promotion. The Promoter will use reasonable efforts to notify you should

this occur by publishing a notice on its website.
