Afterpay Deal Drop NZ Promotion Terms

1. General terms for Afterpay Promotions

1.1 These terms and conditions apply to all promotions (Afterpay Promotions) offered by Afterpay NZ Limited (NZBN 9429 046 246 837) (Afterpay) unless stated otherwise.

1.2 Some Afterpay Promotions may include additional terms (Additional Promotion Terms). These Additional Promotion Terms may be set out in promotional material (for example, an email) or in-app.

1.3 Together, these terms and conditions and any applicable Additional Promotion Terms make up the Promotion Terms.

1.4 There may be circumstances where a specific term in the Additional Promotion Terms is inconsistent with these terms and conditions. If that is the case, the specific term of the Additional Promotion Terms is the one that applies to the extent it is consistent with these terms and conditions.

1.5 An Afterpay Promotion may be modified or withdrawn at any time. If Afterpay does this, it will generally provide notice of this (however, Afterpay may modify or withdraw an Afterpay Promotion do so without notice where it has reasonable grounds for doing so).

1.6 Afterpay may, acting reasonably and in good faith, withhold, refuse, limit, reverse or otherwise cancel an Afterpay Promotion that it determines or believes was obtained fraudulently, illegally, in error, or in violation of the Promotion Terms, including through misuse (for example, technical manipulation).

1.7 The Promotion Terms do not limit or exclude your consumer rights and guarantees under the Consumer Guarantees Act.

2. Afterpay Promotion conditions

2.1 An Afterpay Promotion is valid only for eligible transactions and may be limited to:

(a) specified recipients, including a number of users who first redeem the Afterpay Promotion, first-time users of Afterpay or recipients of promotional material;

(b) locations;

(c) retailers or third party suppliers;

(d) products or services acquired using your Afterpay account; and

(e) Afterpay products or ways an Afterpay product is used (for example, in-app or in-store transactions).

2.2 Unless expressly stated otherwise, an Afterpay Promotion:

(a) cannot be used in conjunction with other Afterpay Promotions;

(b) can only be used or redeemed once per eligible transaction;

(c) is not transferable;

(d) cannot be redeemed for cash; and

(e) is subject to stock availability and the operating hours and availability of participating retailers or third party suppliers.

2.3 If an Afterpay Promotion specifies a minimum transaction requirement or value, the promotion is only valid if the transaction meets or exceeds the stated requirement or value.

2.4 If an Afterpay Promotion specifies that a percentage discount applies, it may also set a maximum discount or cap the maximum discount available. If it does, the Afterpay promotion is only valid up to the maximum discount or cap as specified in the Promotion Terms.

2.5 An Afterpay Promotion may specify an expiry date or period of time it remains valid. If it does, the Afterpay Promotion will expire at the end of the expiry date or period. The relevant timeone for all expiry times is NZST. If no expiry date or period is specified, the Afterpay Promotion will expire within 30 days.

2.6 If an Afterpay Promotion contains a promotion code, you may be required to apply the promotion code at the time of performing the eligible transaction in order to redeem it.

3. Application of Afterpay offers

3.1 Unless expressly stated Afterpay Promotions apply to eligible transactions only and cannot be used towards any fees (including late fees) or outstanding repayments in connection with your Afterpay account or any credit contract you have with us.
