AU Consumer Survey (Promotion) - Terms and Conditions

●      The prize draw will occur at 11:00AM on 05/07/2024 AEST and a total of 4 winners will be notified by email and have their names published at https://www.afterpay.com/en-AU/consumer-survey-terms-and-conditions-11062024.

●      Each winner will receive 1 x AUD$250 Prezzee Voucher. Total prize pool value is AUD$1,000.

●      To redeem a prize, each winner must have a valid Prezzee account or sign up to have a Prezzee account.

●      This Promotion is administered by the Promoter.

●      Your Personal Information may be used by the Promoter and disclosed to third parties for various purposes (see clauses 21 - 23 for full details).

●      Afterpay may disqualify entries and entrants for a number of reasons, including if you breach these terms (see clause 10 for full details).

●      Afterpay accepts no responsibility for: (i) late, lost or misdirected entries, (ii) prizes lost, misplaced or otherwise not delivered to a winner, (iii) errors (technical or human), technical failures or malfunctions except where caused by Afterpay’s fraud, negligence or wilful misconduct, and (iv) any injury, sickness, death, or property loss or damage of any kind except where caused by Afterpay’s fraud, negligence, or wilful misconduct.

●      If the Promotion cannot be run as planned for any reason beyond the reasonable control of Afterpay, Afterpay may, subject to licensing authority approval, alter, cancel, terminate, modify or suspend the Promotion.

Promoter

1. The Promoter is Afterpay Australia Pty Ltd (ABN 15 169 342 947) at Level 8, 376-390 Collins Street Melbourne VIC 3000.

Promotion Partner

1. The Promotion Partner is Prezzee Pty Limited (ABN 16 602 963 422) at Level 3/9 Castlereagh St, Sydney NSW 2000 Australia, who may benefit from the undertaking of this Promotion.

Eligibility

1. Subject to the ineligibility criteria in clause 4, entry is open to Australian residents 18 years and older (Eligible Entrants).

1. Employees and other staff (and their immediate family members) of the Promoter or the Promotion Partner are ineligible to enter.

1. Entrants are subject to all applicable laws, and entries will be deemed void where prohibited by law.

1. By entering this Promotion, entrants agree to be bound by these terms and conditions. In case of any inconsistency between these terms and conditions and any other published material, these terms and conditions prevail.

Entry

1. The Promotion commences at 11:00AM on 19/06/2024 AEST and closes at 11:00AM on 28/06/2024 AEST (Promotion Period).

8.    To enter, during the Promotion Period Eligible Entrants must:

a.       click the link in the email;

b.       complete the 15 minute survey; and

c.       once the entrant has submitted the completed survey, they will automatically go into the draw to win.

1. Eligible Entrants may not enter more than once. Each Eligible Entrant may only be awarded one prize. All entries become the property of the Promoter for use by the Promoter without attribution or compensation.

1. Entries that the Promoter suspects to be fraudulent, incomplete, incorrect or misleading, or may damage the Promoter’s reputation may be disqualified. Entrants who breach these terms and conditions may be disqualified. The Promoter accepts no responsibility for late, lost or misdirected entries.

1. It is the entrant’s responsibility to notify the Promoter should their contact details change during the Promotion Period.

1. There is no fee to enter this Promotion.

Prizes and winning

1. The random prize draw will take place at 11:00AM on 05/07/2024 AEST at the Promotion Partner's office at Level 3/9 Castlereagh St, Sydney NSW 2000.

4. There will be a total of 4 winners, who will be notified by email within 2 business days of the draw date on 05/07/2024. The winners' names will be published within 2 business days of the draw date on 05/07/2024 for at least 28 days.

1. Each winner will receive 1 x AUD$250 Prezzee Voucher. Total prize pool value is AUD$1,000. Prizes are subject to any terms and conditions (which may be notified to the winners upon confirmation of the award of the prize).

1. If any prizes remain unclaimed after reasonable attempts to contact a winner, this will be published 30 days after the initial prize draw on 05/07/2024. A subsequent unclaimed prize draw will be conducted at 11:00AM on 05/08/2024 AEST at the same location and in the same manner as the initial prize draw. Any redraw winner will be notified by email within 2 business days of the unclaimed prize draw on 05/08/2024 and will have their name published on https://www.afterpay.com/en-AU/consumer-survey-terms-and-conditions-11062024 for at least 30 days.

1. The Promoter may request reasonable identification from the winners to confirm their identity and eligibility to enter. Any failure to do so may result in disqualification.

1. The Promoter accepts no responsibility for prizes lost, misplaced or otherwise not delivered to a winner. If any prize or part of a prize becomes unavailable for reasons outside of the Promoter’s control, the Promoter may substitute a prize of equal or greater value. Prizes are not transferable or redeemable for cash.

1. The Promoter’s decision on any aspect of this Promotion is final and binding. No correspondence will be entered into.

1. Entrants consent to their entry and Personal Information being collected and used by the Promoter and Promotion Partner for the purposes of this Promotion and by the Promoter for marketing purposes. The Promoter may use, reproduce or modify the entry in any way without any further reference, payment or compensation to the entrant.

1. Personal information collected will be used in accordance with the Promoter’s Privacy Policy (https://www.afterpay.com.au/privacy/). The Promoter may disclose Personal Information to other organisations (including third parties) for the purposes of conducting the Promotion, promotional, marketing, publicity, research and profiling. Entrants may access or change their personal information by contacting the Promoter by email at [email protected].

Other terms

1. These terms and conditions do not limit, modify or exclude consumer guarantees as provided in the Australian Consumer Law under the Competition and Consumer Act 2010 (Cth). The Promoter may amend any of these terms and conditions if required to comply with applicable laws.
